These Uber Pass Complimentary Terms and Conditions (“Complimentary Pass Terms”) together with the Terms and Conditions for Renewable Passes and Uber Terms of Use, Privacy Policy, Uber’s Community Guidelines and Uber Cash Purchase Agreement incorporated therein (collectively, the “Uber Terms”) govern the enrollment and use of the limited time promotional complimentary Uber Pass monthly subscription (currently $9.99/month plus tax) of up to 3, 6 or 12 consecutive months (based on card type as shown in the offer) (“Complimentary Uber Pass”) offered by Uber Portier Canada Inc. (together with its parent, subsidiaries and affiliates) (collectively, “Uber”). In the event of any conflict between these Complimentary Pass Terms and the Uber Terms, these Complimentary Pass Terms shall govern as applied to the subject matter herein. Subject to the foregoing, undefined, capitalized terms in these Complimentary Pass Terms will have the meaning set forth in the Uber Terms. This offer is only available to those Canadian Aeroplan program members who are cardholders of the TD® Aeroplan® Visa* Platinum Card, TD® Aeroplan® Visa Infinite* Card, TD® Aeroplan® Visa Infinite Privilege* Card, or TD® Aeroplan® Visa* Business Card, with an account that is open with active charging privileges and is not lost, stolen, closed or fraudulent (each, an “Eligible Card”) . The list of Eligible Cards may be amended at any time without notice.
To participate in this offer, a cardholder of an Eligible Card (an “Eligible Cardholder”) must enroll (“Participating Cardholder” or “you”) any time prior to September 8, 2022 (the “Enrollment Window”). Attempted enrollment outside the Enrollment Window will not qualify for a Complimentary Uber Pass. Eligible Cardholders that have an existing active auto-renewing Uber Pass subscription qualify and may enroll in this offer. Eligible Cardholders that have an existing complimentary Uber Pass subscription shall not qualify until their existing complimentary Uber Pass subscription terminates. Once enrolled in the Complimentary Uber Pass, a Participating Cardholder will not be charged the monthly subscription fee for their Complimentary Uber Pass for up to 3, 6, or 12 consecutive months (as shown in their offer)(the “Complimentary Pass Benefit Window”). If a Participating Cardholder has an existing active auto-renewing Uber Pass subscription at the time of enrollment in the Complimentary Uber Pass, then such Cardholder’s Complimentary Uber Pass will commence as of the first day of next billing cycle for the existing Uber Pass subscription.
To enroll in this offer, an Eligible Cardholder must: (i) download or update to the latest version of the Uber App or Uber Eats App; (ii) once the app is downloaded or updated, the Eligible Cardholder must sign into their existing Uber account or sign up to create a new account; (iii) during the Enrollment Window, add an Eligible Card (or already have an Eligible Card) as the method of payment in their Uber Account; (iv) be presented with the Complimentary Uber Pass offer in the Uber App or Uber Eats App; and (v) signify acceptance of the offer by following the activation instructions accompanying the offer. Once these steps are fully completed, such Eligible Cardholder will be enrolled as a Participating Cardholder in the Complimentary Uber Pass (currently $9.99/month subscription fee plus tax) for the applicable Complimentary Pass Benefit Window. Eligible Cards added to an Eligible Cardholder’s Uber account through a third party such as Apple Pay or PayPal will not qualify and will not be eligible for the Complimentary Uber Pass offer.
Once enrolled, a Participating Cardholder will receive a Complimentary Uber Pass subscription up to the applicable Complimentary Pass Benefit Window (as shown in your offer) beginning on the date of enrollment in the offer. To receive the Complimentary Uber Pass benefits more fully described on the Uber Pass landing page, you must use the Eligible Card used to enroll in the offer for purchasing eligible deliveries or trips in Canadian cities where Uber Eats or Uber Rides is available. It may take up to 48 hours for the Complimentary Uber Pass subscription to be available for use after enrollment.
When you enroll in this offer, you understand that the Uber Pass is an automatic monthly renewal subscription and, until cancelled by you, will automatically renew each month in accordance with the Terms and Conditions for Renewable Passes and agree that, at the end of your applicable Complimentary Pass Benefit Window, the selected payment method in your Uber App will be auto-billed at the then current Pass Rate (currently $9.99/month subscription fee plus tax), and will continue to be auto-billed at the then current Pass Rate until you elect to cancel your Renewable Pass. This means that at the end of your applicable Complimentary Pass Benefit Window Uber will collect the then current Pass Rate (currently $9.99/month subscription fee plus tax) by charging the selected payment method that Uber has on record in the Uber App for you without notifying you, unless notification is required by applicable law. You may confirm the date of your renewal within the Account Management Hub of the Uber Pass section in the Uber Eats App or Uber Rides App. If you want to cancel your subscription, you may do so within the Account Management Hub of the Uber Pass section in the Uber Eats App or Uber Rides App up to 48 hours before your next scheduled payment. If you want to cancel within 48 hours of your next scheduled payment, please contact Uber support.
If you choose to opt out of your Complimentary Uber Pass subscription prior to the end of your Complimentary Pass Benefit Window by turning off the auto-renew functionality in the Uber Eats App or Uber Rides App or if you cancel or remove your Eligible Card from your Uber account, your Complimentary Uber Pass subscription will be canceled at the end of the current month of your Complimentary Pass Benefit Window.
If you transfer to another Eligible Card, your Complimentary Uber Pass subscription offer may change. If you transfer to another Eligible Card or your Eligible Card expires or is replaced, or your card details change during your Complimentary Pass Benefit Window, you may need to remove your previous payment card and add your new Eligible Card details to continue enrollment in the Complimentary Uber Pass subscription. If your payment card details change and you do not update your new Eligible Card details prior to your next billing cycle, you will be unenrolled from Complimentary Uber Pass. Once you update your card details in the Uber Eats App or Uber Rides App, you will need to re-enroll to continue your Complimentary Uber Pass subscription. The offer will still expire at the end of the original Complimentary Pass Benefit Window from the date you first enrolled in this offer.
If you add a new Eligible Card to your Uber Eats App or Uber Rides App during the Enrollment Window, you will still only have access to one (1) Complimentary Uber Pass subscription per account and the offer will still expire at the end of the original Complimentary Pass Benefit Window from the date you first enrolled in this offer.
Eligible Cardholders are only entitled to receive this offer on one Uber Eats or Uber Rides account. If an Eligible Card is added to multiple Uber Eats or Uber Rides accounts, only the first Uber Eats account or Uber Rides account to which the Eligible Card is added will be eligible for the offer. You will only be entitled to one Complimentary Uber Pass subscription.
The Complimentary Pass Terms and the Uber Terms (including the Terms and Conditions for Renewable Passes) are subject to change in accordance with their terms. Neither Aeroplan nor any bank which issues Eligible Cards has any liability or responsibility for any such changes. Fulfillment of the offer is the sole responsibility of Uber. For purposes of fulfilling this offer, you understand and agree that Uber and the payment card network of the Eligible Cards will share certain information about your Eligible Card, including the Eligible Card type and updated Eligible Card information and activation status, as may be necessary to confirm your offer eligibility.
